School Attendance Orders

A School Attendance Order (SAO) is a legal document issued by a local authority to parents/carers when they believe a child of compulsory school age is not receiving a suitable education, either at school or otherwise. The SAO requires the parent/carer to register the child at the named school or provide evidence of alternative suitable education. Failure to comply with an SAO is an offense. 

Supporting the SAO Process

Cooperate with the local authority

Schools should be prepared to cooperate with the local authority when a school attendance order is being considered or implemented. 

Provide information as needed

Schools may be asked to provide information about a pupil’s attendance, behaviour, and educational progress as part of the SAO process. 

Naming a School

If a school is named in a School Attendance Order (SAO), they must admit the child. Fair Access Panel, If there are no available places at a school named in an SAO, the local authority may refer the case to the Fair Access Panel, which will then determine which school the child should attend. 

Advise the parent

If the school has any concerns about a child’s education or attendance, they should advise the parent and explore ways to address the issues before resorting to formal action.
